Terms of Service

1. Agreement to Terms

By accessing or using target.ai (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

target.ai is a party game where players guess where concepts fall on a spectrum between two opposing ideas. The Service utilizes Artificial Intelligence to generate optional word pair content for enhanced gameplay.

3. User Accounts and Data Persistence

• No Login Required: The Service operates without traditional user accounts (email/password).
• Device-Based Access: Your access, game history, and Paid Subscriptions are managed through your device and app store account.
• Risk of Data Loss: You acknowledge that clearing your app data or resetting your device may result in the loss of local settings and preferences. Subscriptions can be restored through your app store account.

4. Subscription and Payments

• Premium Service: We offer subscription plans that unlock additional word packs, custom categories, and AI-powered features.
• Billing: Payments are handled by third-party processors (Apple App Store, Google Play Store).
• Cancellation: You may cancel at any time through your app store account settings. Access continues until the end of the current billing period.
• Refunds: Refunds are handled on a case-by-case basis and are subject to the policies of the platform or payment processor.
• Price Changes: We reserve the right to adjust pricing for our Service or any components thereof in any manner and at any time as we may determine in our sole discretion. Any price changes will take effect following notice to you.
• App Store and Google Play Purchases: If you purchase a subscription through a third-party app store (such as the Apple App Store or Google Play), your billing relationship is with that store. Subscription management, renewals, cancellations, and certain refund requests may need to be handled directly through your Apple or Google account settings and are subject to the applicable store's terms and policies.

5. User Conduct and Content

You are responsible for the inputs you provide to the AI generator. You agree not to use the custom category feature to generate:

• Hate speech, harassment, or threats.
• Sexually explicit or pornographic content.
• Illegal content or content that promotes illegal acts.

We reserve the right to rate-limit or restrict access for users found to be abusing the AI generation features.

6. AI Disclaimer

The Service uses Artificial Intelligence (OpenAI) to generate word pair content for gameplay.

• Accuracy: We do not guarantee that AI-generated word pairs will always be accurate, appropriate, or error-free.
• Hallucinations: AI models may occasionally produce nonsensical or unrelated results ("hallucinations").
• Entertainment Only: All AI-generated content is intended for entertainment purposes only.

7. Intellectual Property

The source code, design, "target.ai" branding, and sound assets are owned by TappedIn Club LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial entertainment.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, TappedIn Club LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the service.

10. Governing Law

These Terms shall be governed by the laws of California, without regard to its conflict of law provisions.

11. Dispute Resolution and Class Action Waiver

Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration rather than in court. You and TappedIn Club LLC agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12. Indemnification

You agree to defend, indemnify, and hold harmless TappedIn Club LLC and its licensees and licensors from and against any claims, actions, or demands, including, without limitation, reasonable legal and accounting fees, resulting from your breach of this Agreement or your access to, use, or misuse of the AI generation features.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
